39112 - Οι λανθασμένες αναφορές

Ακόμα κι όταν υπάρχουν άρθρα στη Συμφωνία των ΥπΕξ στις Πρέσπες που μοιάζουν με άλλα άρθρα της Ενδιάμεσης Συμφωνίας οι αναφορές τους δεν είναι οι ίδιες. Ενώ το κείμενο φαίνεται να είναι το ίδιο όσον αφορά στις λέξεις οι αναφορές στους αριθμούς δεν είναι οι ίδιες. Και αυτό δεν οφείλεται στο γεγονός ότι η μία έχει 20 άρθρα και η άλλη 23 άρθρα, όχι το σύστημα αναφοράς είναι διαφορετικό, διότι το άρθρο που είναι πηγή είναι διαφορετικό και έχει άλλη διατύπωση και άλλες επιπτώσεις. 

Το Άρθρο 13 αναφέρεται στο Άρθρο 18 στην νέα Συμφωνία, ενώ το Άρθρο 13 αναφέρεται στο Άρθρο 12 στην Ενδιάμεση Συμφωνία. Όμως τα Άρθρα 18 και 12 δεν είναι ταυτόσημα. Πιο συγκεκριμένα έχουμε τα εξής

Α12 (1) (a) (b) (c)  = A18 (1) (a) (b) (c)

A12(3)                  = A18(2)

Όμως το A18(2) δεν έχει ανάλογό του και το Α18(4) είναι διαφορετικό από το Α12(3).

Η Ενδιάμεση Συμφωνία έγραφε μόνο: The Parties shall promptly consult with a view to entering into new agreements substantially similar to those referred to above. Ενώ η νέα Συμφωνία γράφει: 2. The Parties agree that, upon entry into force of the present Agreement, all international documents binding on the Parties bilaterally shall remain in force, unless specifically terminated by this Agreement.

Στο Άρθρο 12 (3) έγραφε η Ενδιάμεση Συμφωνία:

3. The Parties may  conclude additional bilateral agreements in areas of mutual interest. Ενώ το Άρθρο 18 (4) της Συμφωνίας λέει:

4. The Parties commit to explore all possibilities to conclude additional bilateral agreements needed with regard to areas of mutual interest.

Έτσι βλέπουμε ότι τα αρχικά άρθρα δεν είναι ταυτόσημα διότι έχουν άλλες αναφορές και θα ήταν καλό να το εντοπίσουν και οι βουλευτές της Ελλάδας.

Article 13

Having regard to the fact that the Second Party is a landlocked State, the Parties shall be guided by the relevant provisions of the United Nations Convention on the Law of the Sea as far as applicable both in practice and when concluding agreements referred to in Article 18 of this Agreement.

Article 18

1. Upon entry into force of this Agreement, the Parties shall in their relations be directed by the provisions of the following bilateral agreements that had been concluded between the former Socialist Federal Republic of Yugoslavia and the First Party on 18 June 1959:

a) The convention concerning mutual legal relations,

b) The agreement concerning the reciprocal recognition and the enforcement of judicial decisions, and

c) The agreement concerning hydro-economic questions.

2. The Parties agree that, upon entry into force of the present Agreement, all international documents binding on the Parties bilaterally shall remain in force, unless specifically terminated by this Agreement.

3. The Parties shall consult with each other in order to identify other agreements concluded between the former Socialist Federal Republic of Yugoslavia and the First Party that will be deemed suitable for application in their mutual relations.

4. The Parties commit to explore all possibilities to conclude additional bilateral agreements needed with regard to areas of mutual interest.

INTERIM ACCORD

Article 12

1. Upon entry into force of this Interim Accord, the Parties shall in their relations be directed by the provisions of the following bilateral agreements that had been concluded between the former Socialist Federal Republic of Yugoslavia and the Party of the First Part on 18 June 1959:

(a) The convention concerning mutual legal relations,

(b) The agreement concerning the reciprocal recognition and the enforcement of judicial decisions, and

(c) The agreement concerning hydro-economic questions.

The Parties shall promptly consult with a view to entering into new agreements substantially similar to those referred to above.

2. The Parties shall consult with each other in order to identify other agreements concluded between the former Socialist Federal Republic of Yugoslavia and the Party of the First Part that will be deemed suitable for application in their mutual relations.

3. The Parties may conclude additional bilateral agreements in areas of mutual interest.
